On September 5, 2017, the Trump Administration and the Department of Homeland Security (DHS) announced its plan to formally rescind the Deferred Action for Child Arrivals program, known as DACA. In deciding to end the DACA program, DHS points to the creation of the program by President Obama as an “unconstitutional exercise of authority by the Executive Branch” and assumes that any legal challenge to the program would render it unlawful.
